Summary of
Model Standards of Conduct for Mediators
|
STANDARD I Self - Determination
The mediator shall conduct mediation based on the principle of self-determination by the participants.
STANDARD II Impartiality
The mediator shall conduct the mediation process in an impartial manner.
STANDARD III Conflicts of Interest
The mediator shall disclose all actual and potential grounds of bias and conflicts of interest reasonably
known to the mediator.
STANDARD IV Competence
The mediator shall be qualified by education and training to undertake the mediation.
STANDARD V Confidentiality
The mediator shall maintain the confidentiality of all information acquired in the mediation process unless the mediator is permitted or required to reveal the information by law or agreement of the participants.
STANDARD VI Quality of the Process
The mediator shall conduct mediation in a manner that promotes diligence, timeliness, safety, presence of
appropriate participants, party participation, procedural fairness, party competency and mutual respect among
all participants.
STANDARD VII Advertising and Solicitation
The mediator shall be truthful in the advertisement and solicitation for mediation.
STANDARD VIII Fees and Other Charges
The mediator shall fully disclose and explain the basis of any compensation, fees and charges to the participants.
STANDARD IX Advancement of Mediation Practice
The mediator shall act in a manner that advances the practice of mediation.

Mosaic Mediation follows the Model Standards of Conduct for Mediators developed and adopted by the American Bar Association, American Arbitration Association and Association for Conflict Resolution in September of 2005.
